Terms of use

Fern operates a property listing platform with search, account and publication tools, and also provides brokerage and rental services. Listings may be published by Fern or by other advertisers. Browsing a listing, contacting an advertiser or receiving a platform verification status does not by itself conclude a sale, lease, reservation, agency agreement or payment instruction.

When you engage Fern for brokerage or rental services, the parties, Fern's role, scope of work, fees and payment conditions must be set out in a separate agreement before the service is ordered. The advertiser, property owner and any other service provider must be identified in the relevant interaction or agreement. Operating the platform does not make Fern the owner of every listed property or a party to every transaction.

Provide accurate account information, keep it updated and protect your credentials. Use company functions only with current authority. A company owner is responsible for granting and reviewing member access. Do not share credentials or impersonate an owner, advertiser, employee or moderator.

You must have the legal capacity and permissions required for your actions. Notify Fern if an account or company invitation is used without authority. Account and access restrictions may be applied to protect people and the service.

An advertiser must have the right to advertise the property and to use its photos, plans, description and contact information. Provide accurate material details, price and availability; update or withdraw an outdated offer. Do not conceal relevant limitations or publish misleading ownership claims.

Do not publish personal documents, unrelated personal information, unlawful content, malicious files, discriminatory material or deceptive promotions. Do not use the service for fraud, unsolicited messaging, unauthorised data extraction or attempts to bypass access controls.

Fern's checks distinguish the identity or existence of a property, a profile's authority to advertise it, and moderation of a particular listing. A right to advertise does not necessarily mean ownership. A verified status is not a title search, legal opinion or guarantee that all facts remain current.

Verification may rely on submitted evidence and recorded moderator assessments. Buyers and tenants should independently check title, encumbrances, permissions, the counterparty and the transaction documents before committing funds.

You retain rights you hold in submitted content. You grant Fern the permissions reasonably needed to store, review, format, translate and display that content for the requested service, including technical copies and previews. Private verification evidence is not licensed for public advertising merely because it was uploaded.

Do not submit material you cannot lawfully use. Fern's branding, software and original editorial material remain protected by applicable rights. Any restriction on reuse is subject to permissions and exceptions provided by law.

Fern may request corrections or evidence, restrict publication, suspend access or remove material for a policy breach, security concern, disputed authority or legal requirement. Where appropriate, we should give a reason and an opportunity to seek review, while protecting confidential information and investigations.

Send a complaint with the listing link, the issue, your relationship to it and relevant evidence to the support contact below. Do not place sensitive evidence in a public comment or chat. Abusive or knowingly false complaints are prohibited.

Displayed availability, currency conversions, estimates and editorial information are for reference and may change. Confirm the contractual currency, total price, taxes, fees and payment recipient in the actual agreement. A converted display amount is not a guaranteed exchange quote.

Do not transfer money solely because of a listing or an unsolicited message. For any separately offered paid Fern service, pricing, delivery and applicable cancellation or refund conditions must be provided before the order. These terms do not create a fee that has not been disclosed.

Links, maps and messaging tools may involve third parties with their own terms. Enabling an optional integration allows that feature to connect as described in the cookie policy. A link alone does not establish that Fern has verified every statement made by the external provider.

Use of Google Maps is also governed by the Google Maps/Google Earth Additional Terms of Service. Google's processing of personal information is described in its Privacy Policy. Both documents are linked below.

Use reasonable care when relying on submitted information. Fern cannot promise uninterrupted operation or the accuracy of every advertiser statement. Fern is responsible for its own brokerage and rental services according to the agreed scope, its conduct and applicable law. Other participants remain responsible for their own information and obligations.

Nothing in these terms removes mandatory consumer rights, applicable data-protection rights or liability that cannot lawfully be excluded. A limitation does not excuse fraud or other conduct for which exclusion is prohibited. Any transaction-specific allocation of responsibility belongs in the relevant agreement.

Material changes should be identified by version and communicated as appropriate. If a change requires agreement, Fern must obtain it through the relevant service flow; cookie consent does not supply that agreement.

Applicable mandatory rules and any non-waivable court or consumer rights remain in force. A separate brokerage, rental or transaction agreement may specify the law and dispute procedures applicable to that service, subject to those rules. Contact support to seek a resolution of a concern; this does not limit your right to use available legal remedies.
