Who is responsible
The website operator and privacy contact are identified below. This notice covers Fern's website, its account area, and information handled for brokerage and rental services you request from Fern. A property advertiser may separately be responsible for information you provide directly to them. External websites and messaging services explain their own processing in their privacy notices.
Information we receive
Account information includes your name, sign-in email, password credentials, account status, verification events and access to individual or company profiles. Passwords are stored as hashes. Public profile contact details and company information are maintained separately from sign-in details.
Property information includes addresses, locations, prices, descriptions, photos, plans, drafts and publication history. Verification submissions may include property document details, documents supporting a right to advertise, and information about an owner or representative. Please supply only information relevant to that check and redact unrelated personal details where possible.
If you request brokerage or rental services, we may also receive your contact details, property requirements, viewing arrangements, correspondence and information needed for the agreed service or transaction. Supply only the information relevant to your request.
We also process requests to support, security and service logs, and technical information needed to deliver pages and maintain sessions. If you enable an optional service, its provider receives the information needed for that service: for example, map connection data, messages sent to the chat, or browser error reports.
Why we use information
We use information to provide requested account, listing, brokerage and rental services, verify submissions and authority to act, manage company access, respond to enquiries and prevent misuse. Depending on the activity and applicable law, the basis may be taking requested steps or performing a contract, complying with a legal obligation, or a legitimate interest in security and reliable operation after considering your rights.
Optional browser preferences, interactive Google Maps, the Nextbot chat and browser diagnostics are controlled through your privacy choices. Where processing relies on consent, you may withdraw it. Declining optional features does not prevent ordinary browsing or account access; the declined feature itself may be unavailable.
A cookie choice is not agreement to advertising messages or acceptance of a property transaction. Any future marketing subscription requiring consent must offer a separate choice and a way to unsubscribe.
Public information and private documents
Published listings and public company profiles can be viewed, copied or indexed by other people and search engines. Public contact blocks show the advertiser, developer or project contacts selected by authorized staff, or FERN agency contacts when replacement is enabled. Your sign-in email is not used as a public contact.
Verification evidence and unpublished draft media are not public listing attachments. Access depends on your current account role and the submission context. For company submissions, authorised company members and relevant Fern moderators may have access. Revoking a member's access does not remove copies they previously obtained.
Who may receive information
Access may be available to authorised Fern staff, authorised members of your company workspace, and providers of hosting, storage, email delivery and operational support as needed for their tasks. We may disclose information to competent authorities or other parties where required by law or necessary for a lawful claim.
For requested brokerage or rental services, relevant information may be shared with property owners, prospective buyers or tenants, their representatives and professional advisers as needed for the request or agreed service and permitted by law.
Google supplies interactive maps; Nextbot supplies the optional chat; Sentry receives optional browser diagnostics. Selecting one optional service does not enable the others. Information you send to an advertiser or through an external messenger reaches that recipient under the circumstances shown when you use that channel.
Providers may process information outside Thailand. Applicable Thai data-protection requirements govern these transfers. Contact our privacy address for information about the providers, processing locations and safeguards relevant to your data.
How long information is kept
Retention depends on purpose and ongoing need. Account and profile information supports the account lifecycle; listing history supports publication and disputes; verification evidence supports the relevant check and authority to advertise. For brokerage and rental services, retention depends on the requested service, its completion, applicable legal duties and any related claims. Security records, backups and records required by law may follow separate retention arrangements with restricted access.
Closing an account or withdrawing optional consent does not necessarily erase every record immediately. Information no longer needed should be deleted or anonymised, subject to applicable legal duties and claims. Browser storage durations are listed in the cookie policy.
Your choices and requests
Subject to applicable law and its exceptions, you may request access, a copy, correction, deletion, restriction or portability of your personal data, object to relevant processing, and withdraw consent. You may also complain to the competent data protection authority; in Thailand this includes the Office of the Personal Data Protection Committee.
Use the privacy contact below and describe the request and the account or information involved. We may request proportionate verification of identity or authority, without asking for unrelated documents. A restriction or refusal must have an applicable reason; data belonging to other people must also be protected.
Open Cookie settings at any time to change optional browser permissions. Withdrawal applies to future consent-based activity and does not invalidate earlier lawful processing. You can manage public profile contact details in your account settings.
Security and account responsibility
Fern uses access controls, password hashing and private access to verification evidence. Keep your credentials confidential and report suspected unauthorised access. No online service can guarantee absolute security. Security incidents must be handled according to applicable notification duties.
Do not upload unrelated sensitive information or identity documents into public listings or the online chat. When submitting information about another person, ensure you have an appropriate basis and provide the relevant notice.
Legal capacity and moderation
Account and advertising functions are intended for people with the legal capacity and authority required for the action, or an authorised representative where permitted. Contact us if information about a child or another person has been submitted without appropriate authority.
A moderation or verification result concerns the specific platform check described in the service. It is not a legal opinion, a guarantee of title or a recommendation to enter a transaction.
Changes to this notice
Each published notice identifies its version. Material changes should be communicated through an appropriate channel. When an optional processing purpose changes in a way requiring new consent, that purpose must remain disabled until a new choice is made. Merely reading an updated notice does not grant optional consent.
